Terms of Service

Please read these Terms carefully before using LambKin. They explain your rights, our responsibilities, and important limitations.
1. About LambKin
LambKin is a mobile application that helps parents and caregivers track child habits, activities, feeding, sleep, and developmental milestones. LambKin includes hands-free voice logging through Siri Shortcuts and iOS App Intents on iPhone, plus an in-app voice microphone on any device, iOS Live Activities that show active sleep timers on your lock screen and Dynamic Island, real-time caregiver sync, deterministic sleep-window predictions (Smart Day), and optional AI-generated suggestions for food logging and sleep schedules. These Terms of Service ("Terms") govern your use of LambKin, including the mobile application and any associated services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
2. Smart Day, AI Features & Important Disclaimer
LambKin includes three optional intelligent features. Each works differently and carries different limitations. • Smart Day predictions (free + enhanced in Premium). Smart Day shows your next predicted nap window, bedtime window, and a guidance level (e.g., "approaching", "now", "late"). It is computed by deterministic server-side logic that combines (a) age-band wake-window reference ranges informed by published pediatric sleep research, and (b) statistics measured from your child's recent sleep logs (median wake window, typical bedtime, nap count, etc.). Smart Day does NOT use a large language model. The free tier uses age-default wake windows; Premium personalizes them with your child's measured baseline. Confidence levels ("low", "medium", "high") reflect how much data is available, NOT how accurate any individual prediction will be. • Sleep Schedule Optimization (Premium). When you generate or refine a daily sleep plan from the Schedule tab, LambKin sends a structured summary of your child's situation to a third-party large language model provider — accessed via the Vercel AI Gateway, which routes to Google's Gemini by default and may fall back to OpenAI or Anthropic — which proposes a candidate schedule. This is generative AI: outputs may be inaccurate, may differ between runs for the same input, and may reflect biases in the underlying model. You always remain in control — proposed plans must be reviewed and accepted by you before they take effect. • AI Food Logging (Premium). When you take a photo of food, an AI model identifies likely items so you can quickly log a meal. Recognition may misidentify items, ingredients, or quantities. IMPORTANT: NONE OF THESE FEATURES CONSTITUTE MEDICAL, NUTRITIONAL, DEVELOPMENTAL, OR SLEEP-TRAINING ADVICE. Specifically: • Smart Day predictions and Sleep Schedule Optimization plans estimate the TIMING of sleep windows. They are not prescriptions for how long your child should sleep, are not a sleep-training method, and are not a substitute for guidance from your pediatrician or a qualified sleep professional. • Age-band reference ranges are population averages. Your individual child may differ due to temperament, development, health, illness, travel, or other circumstances. • Smart Day predictions and AI-generated plans should never be relied on for safety-critical decisions (e.g., judging whether a child is ill, distressed, or needs medical attention). • AI Food Logging is not a substitute for nutritional or allergy guidance and may be wrong about what is in a meal. • In any medical emergency, call 911 or your local emergency number immediately. Always consult a qualified healthcare provider with concerns about your child's health, sleep, feeding, or development. LambKin expressly disclaims all liability for any actions taken or not taken based on Smart Day predictions, AI-generated schedule plans, AI food recognition, or any other algorithmic output within the Service.
3. Voice Features, Siri & Live Activities
LambKin integrates with Siri Shortcuts and iOS App Intents (iPhone), and an in-app voice microphone on any device, so you can start and stop sleep timers, log feeds, diapers, and other activities, and ask questions about your child — all hands-free. • Voice transcripts captured by Siri or your device's speech recognizer are processed only to determine your intent and the resulting log. We do not retain raw transcripts beyond what is necessary to create the log you requested. • Speech-to-text is performed by Apple (iOS) or your device's speech recognizer (Android, provided by Google), on your device or their servers, subject to their respective privacy policies. LambKin receives the resulting text or structured intent. • Live Activities display the status of your active timer (e.g., child name, log type, elapsed time) on your iOS lock screen and Dynamic Island. This data is shared with iOS by your device for as long as the activity is active. You can disable Voice Shortcuts and Live Activities at any time from your device's system settings or from LambKin's settings screen.
4. Eligibility & Account Responsibilities
You must be at least 18 years of age to create a LambKin account. By using the Service, you represent that you are 18 or older. You are responsible for: • Maintaining the confidentiality of your account credentials • All activity that occurs under your account • Ensuring that any caregivers you invite as collaborators are authorized by you • Providing accurate information when setting up child profiles You may not share your account with others without using the built-in collaborator feature. You must notify us immediately at support@lambkin.app if you believe your account has been compromised.
5. Subscriptions & Billing
LambKin offers a free tier with limited features and a premium subscription ("LambKin Pro") that unlocks AI Food Logging, Sleep Schedule Optimization, personalized Smart Day predictions, unlimited voice logs, and other premium capabilities. Free Trial: If you start a free trial, you will not be charged until the trial period ends. You may cancel at any time before the trial ends to avoid charges. Auto-Renewal: Premium subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then. Refunds: Subscription payments are generally non-refundable, except where required by law. If you believe you were charged in error, contact us at support@lambkin.app within 30 days of the charge. Price Changes: We may change subscription prices at any time. We will give you at least 30 days' notice before any price change takes effect. Continued use of the Service after the effective date constitutes acceptance of the new price. Subscriptions are managed through the Apple App Store or Google Play Store. Their respective refund policies also apply.
6. Data & Privacy
LambKin collects and stores data including account information, child profiles, activity logs, voice command transcripts (only as needed to create the log you requested), and photos you choose to attach (e.g., AI Food Logging). When you use Sleep Schedule Optimization, a structured summary of your child's recent sleep history and profile is sent to a third-party large language model provider (Google's Gemini by default, with OpenAI and Anthropic as fallbacks) via the Vercel AI Gateway to generate a candidate schedule. This data is used to provide and improve the Service. We do not sell your personal data to third parties. We do not use your children's data for advertising purposes. Data entered about children is stored securely and is only accessible to your account and any collaborators you explicitly invite. You can delete your account and associated data at any time from the Settings screen. For full details on what data is collected, what is sent to which provider, and how we protect it — please refer to our Privacy Policy at lambkin.app/privacy. The Privacy Policy is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.
7. User Content
You retain ownership of all content you input into LambKin, including notes, activity logs, photos, and child profile information ("User Content"). By submitting User Content to LambKin, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing the Service to you and your invited collaborators. You are solely responsible for your User Content. You represent and warrant that your User Content: • Does not violate any applicable law or regulation • Does not infringe the intellectual property rights of any third party • Does not contain harmful, abusive, or illegal content
8. Prohibited Uses
You may not use LambKin to: • Violate any applicable law, regulation, or third-party rights • Attempt to gain unauthorized access to the Service, other accounts, or our systems • Transmit malicious code, viruses, or other harmful software • Scrape, crawl, or extract data from the Service by automated means • Use the Service for commercial purposes without our written consent • Impersonate any person or entity • Interfere with or disrupt the integrity or performance of the Service • Attempt to reverse engineer, decompile, or disassemble the application
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAMBKIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES • LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES • ANY DAMAGES ARISING FROM RELIANCE ON SMART DAY PREDICTIONS, AI-GENERATED SLEEP SCHEDULES, AI FOOD RECOGNITION, OR ANY OTHER MACHINE-GENERATED OR ALGORITHMIC OUTPUT WITHIN THE SERVICE • ANY DAMAGES ARISING FROM RELIANCE ON VOICE-TRIGGERED ACTIONS, INCLUDING MISRECOGNIZED VOICE COMMANDS OR LIVE ACTIVITY TIMER DRIFT • ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE IN NO EVENT SHALL LAMBKIN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LAMBKIN IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100 USD. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by: • Sending a notification through the app, or • Emailing the address associated with your account, or • Displaying a prominent notice within the Service When we publish a new version of these Terms, you will be asked to re-accept them within the mobile app before continuing to use the Service. If you do not agree with updated Terms, you must stop using the Service and may delete your account.

Legal Entity & Governing Law
LambKin is a product owned, operated, and distributed by Everwood Ventures LLC, a limited liability company organized and existing under the laws of the United States. All rights, title, and interest in and to the LambKin application, brand, and associated intellectual property are owned by Everwood Ventures LLC.
These Terms of Service constitute a legally binding agreement between you ("User") and Everwood Ventures LLC ("Company," "we," "us," or "our"). Any reference to "LambKin" herein refers to the Company and its products and services collectively.
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which Everwood Ventures LLC is registered, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction, and you hereby consent to personal jurisdiction and venue in such courts.
